Conditions of Sale

The offer and sale of products on the website are regulated by the following

      1. Seller
        The products purchased on the website are sold directly by Penelope Srl, registered at the Trade Register of Rome, Economic and Administrative Index N. 949434, Tax Identification Code and VAT Registration Number 06092531000, having registered office at Viale Alexandre Gustave Eiffel ,100 gall “E” int 13/14 c/o Commercity (00148) Rome
      2. Acceptance of the General Conditions of Sale
        By submitting an order form, the User unconditionally accepts and undertakes to observe the General Conditions of Sale in relations with Penelope Srl.
        By submitting an order form the User confirms that he/she is aware of and accepts the General Conditions of Sale and additional information contained at www.ordinaryheroes.it, including the Privacy Policy.
      3. Conditions of the Contract – Online Orders
        To place an order for the purchase of one or more products on www.ordinaryheroes.it, the User must fill in the electronic order form following all of the instructions contained on the website.
        The electronic order form contains a summary of the information on the characteristics of each product ordered and the corresponding price, the payment methods that the User can use to purchase each product and the delivery methods of the products purchased, the shipping and delivery costs.
        After sending the order form, Penelope Srl will send an official confirmation of the order via email to the address provided by the buyer.
        The contract is concluded upon receipt by Penelope Srl, of proof of payment of the order, once the order information has been verified as correct.
        A payment receipt must be sent in order for the delivery to be made.
        The order form will be filed in our database for the period of time necessary to process orders and in any case in accordance with the law.
        If the products presented on www.ordinaryheroes.it are no longer available or not on sale when the order form is sent, Penelope Srl will inform the User, within thirty (30) days from the day following the date on which the buyer submitted his order to Penelope Srl, of the possible unavailability of the products ordered.
        If the order form has been sent and the price has been paid for items that are no longer available, the Seller will refund the amount paid for those items.

          1. 3.1 Shipping and delivery of products

            unless otherwise agreed upon in writing between the parties, delivery must take place within the deadline indicated in the order as accepted in the order confirmation or, if the term has not been indicated in the order, within a period of 60 days from the first working day following receipt of the proof of payment of the individual order. The delivery terms are indicative and are not essential terms pursuant to Article 1457 of the Italian Civil Code and, in any case, do not include transport times.
            Except as provided for, Penelope Srl shall not be held liable for delays or non-delivery due to circumstances beyond its control, including but not limited to:

              1. a. inadequate technical data or inaccuracies or delays by the Customer in submitting to Penelope Srl the information or data required for the shipment of the products;
              2. b. difficulty in obtaining supplies of raw materials;
              3. c. problems related to the production or planning of orders;
              4. d. total or partial strikes, the lack of power, natural disasters, measures imposed by public authorities, difficulties in transport, causes of force majeure, unrest, terrorist attacks and all other causes of force majeure;
              5. e. delays caused by the shipper.

             

            The occurrence of any of the events listed above will not entitle the Customer to claim compensation for any damages or indemnities of any kind.
            Unless otherwise agreed in writing by the parties, goods are shipped at the expense and risk of the Customer.
            Unless otherwise agreed in writing between the parties, Penelope Srl will issue invoices at its discretion upon receipt of proof of payment or delivery of products.
            Payment must be paid in Euros.
            By submitting the order form the User agrees to fully accept the specific methods of shipping and delivery of products.
            A payment receipt must be sent in order for the delivery to be made.

         

        1. 3.2 Right of withdrawal and return procedure

          The buyer has the right to withdraw from the contract stipulated with Penelope Srl within 10 working days of delivery of the goods without any penalty and/or reason.
          To exercise this right, the customer must send a notice within 10 days from receipt of the goods via email to the address ordini@ordinaryheroes.it expressly stating that they wish to proceed with the return of the goods ordered.
          Where several items were purchased, withdrawal can also be exercised for some of them only.
          Where the right of withdrawal is exercised, Penelope Srl may refuse to accept the return of the product without the related price tag or whose qualitative characteristics have changed or are damaged or in any case used.
          Where the right of withdrawal is exercised, the User must return to Penelope Srl the goods purchase at his/her own expense, sending it to the seller within 30 days from the date of exercise of the right of withdrawal.
          All goods must be sent to the address of Penelope Srl.
          In order to make the return, the purchased products must arrive at the address indicated above in normal condition.
          The product must be returned with the original product packaging, properly closed, and with the product tag.
          Products already used and/or damaged will not be accepted as returns, including for reasons attributable to inadequate packaging and/or the carriers used.
          The costs of transport of the returned product shall be in any case born by the buyer, except in the case where the products are returned for reasons that are directly caused by the seller, for example if the products have production defects or in case there are errors in delivery.
          Shipments made at the recipient’s expense will not be accepted.
          The item or items purchased in the order can be exchanged with others.
          The shipment of returns made by means other than those indicated above, which are the only ones authorised, will not be accepted.
          The return of goods cannot be made following withdrawal at the expense of the recipient.
          Once the return has arrived at its destination, Penelope Srl will check the legitimacy of the return and, after checking the correctness of the operations, will send the User a confirmation email.
          The sums paid will be credited back through the system by which the payment was made.
          The refund usually occurs within two account statements, or within 120 days, from the date of return.

     

      1. Warranty and product price information

        The main features of products are available to view on the website in the order form.
        The images and colours of the products offered for sale on the website may not exactly correspond to the real products due to the Internet browser and the monitor used.
        Furthermore, due to the possible needs arising from promotional initiatives or commercial and distribution needs, Penelope Srl reserves the right to modify or change the promotional elements and the material with which they are made, without affecting the objective integrity and essential characteristics of the product itself.

     

      1. Non-conformity

        Any deviation in the products delivered to the Customer with respect to the type and quantity indicated in the order must be reported in writing to Penelope Srl within five days from the date of delivery. If the complaint is not communicated within the aforementioned period of time, the delivered products will be deemed as compliant with those ordered by the Customer.

     

    1. Security and privacy

      The specific provisions on security and privacy are specified in the “Privacy Protection – Personal Data Processing” section, and the User agrees to accept them in full upon submission of the order form.

    2. Customer service
      The User can request any information from Penelope Srl by sending an e-mail request to info@ordinaryheroes.it.
    3. Legal domicile, applicable law and jurisdiction
      Penelope Srl is legally domiciled at its main registered office.
      The Conditions of Sale and each individual Sale will be regulated and interpreted in accordance with Italian law with the exclusion of the 1980 Vienna Convention on contracts for the international sale of movable property.
      All disputes arising from/or connected to these Conditions of Sale and/or to any Sale will be subject to the exclusive jurisdiction of the Court of Rome.
      Except as agreed above, Penelope Srl reserves the right, when bringing legal action as a plaintiff, to promote such action in the place of residence of the customer, in Italy or abroad.

    Taxes and customs duties

    Taxes are governed by the laws in force in your country. The organization is not responsible for all sales taxes. Customs costs depend exclusively on the country of destination and the laws of the same. For your safety, you need to research the laws and practices applied by the destination country.
